2. Kapsam
Bu politika, momentumnexus.com internet sitesini ("Site") ziyaret etmeniz veya Site üzerindeki formlardan birini doldurmanız halinde kişisel verilerinizin nasıl işlendiğini açıklar.
Kapsam dışında kalanlar:
app.momentumnexus.com üzerinden sunulan uygulama hizmetleri ile Hubty, Birexit ve Girisim101 markalı ürünler; ayrı metinlere tabidir.
Kariyer başvuruları; üçüncü taraf işe alım platformu üzerinden yürütülür, aday aydınlatma metni orada sunulur.
Müşterilerimiz adına yürüttüğümüz projelerde işlenen kişisel veriler; bu faaliyetlerde Şirket veri işleyen sıfatını taşır (bkz. 8. bölüm).
Site İngilizce yayın yapmakta ve uluslararası bir kitleye hitap etmektedir. Avrupa Ekonomik Alanı veya Birleşik Krallık'tan erişen ziyaretçiler bakımından GDPR hükümlerinin uygulanabileceği hallerde 14. bölüm tamamlayıcı nitelikte uygulanır.

Formların tamamı; bot koruması (Cloudflare Turnstile), geçici e-posta adreslerinin reddi ve IP adresi başına saatte beş gönderim sınırı ile korunmaktadır.
3.2. ICP Finder hakkında özel açıklama
ICP Finder aracına girilen LinkedIn profil adresi, belirli bir gerçek kişiyi doğrudan tanımlayabilen bir veridir.
Bu alana kendi profil adresiniz dışında üçüncü kişilere ait profil adresleri girmeniz halinde, söz konusu paylaşımın hukuka uygun bir sebebe dayanmasından ve ilgili kişilerin aydınlatılmasından siz sorumlu olursunuz. Ürün açıklaması alanına ticari sır niteliğindeki bilgileri yazmamanızı öneririz; bu alan gizlilik yükümlülüğü altında alınmaz.
3.3. Randevu talepleri
Randevu talepleri, Site'ye gömülü Calendly aracı üzerinden alınmaktadır. Bu formu doldurduğunuzda verileriniz doğrudan Calendly'ye iletilir ve Şirket'in sunucularına uğramaz. Calendly, bu işleme bakımından kendi gizlilik politikasını uygular; Şirket, randevu kaydının kendisine iletilmesinden sonra veri sorumlusu sıfatıyla hareket eder.

Zorunlu olanlar dışındaki hiçbir araç, açık rızanız olmaksızın çalıştırılmaz.
3.5. Oturum kaydı ve ısı haritası
Site'nin kullanılabilirliğinin değerlendirilmesi amacıyla Hotjar (site kimliği 5010978) kullanılmaktadır. Bu araç; ısı haritaları, tıklama ve kaydırma davranışını toplamanın yanında, ziyaretinizi sonradan yeniden izlenebilecek bir oturum kaydı hâline getirebilir.
Oturum kaydı yalnızca açık rızanız üzerine çalıştırılır (KVKK m.5/1).
Form alanlarına yazdığınız metnin kayıtlarda maskelenmesi için gerekli yapılandırma uygulanmaktadır. Buna rağmen, formu göndermeseniz dahi yazdığınız metnin kayda konu olabileceği ihtimaline karşı, form alanlarına hassas veya gizli bilgi girmemenizi öneririz.
3.6. Ziyaret eden şirketin tespiti
Site'de Leadfeeder / Dealfront aracı kullanılmaktadır. Bu araç, ziyaretçinin IP adresi üzerinden ters sorgu yaparak ziyaretin hangi şirketten geldiğini tespit eder ve o şirkete atfedilen site içi gezinme geçmişini zaman içinde birleştirir.
Elde edilen bilgi; hangi kurumların hangi sayfalarımızı incelediğini görmek, iş geliştirme faaliyetlerini önceliklendirmek ve kurumsal iletişim kurulacak muhatapları belirlemek amacıyla kullanılır.
Araç, kural olarak kişiyi değil kurumu tanımlamayı hedefler. Ancak işlemenin kendisi kişisel veri niteliğindeki IP adresi üzerinden yürümekte ve az sayıda çalışanı bulunan kurumlarda, gezinme geçmişinin form kayıtlarıyla birleşmesi hâlinde kişinin yeniden tanımlanması ihtimali doğmaktadır. Bu nedenle işleme, kişisel veri işleme olarak ele alınmakta ve yalnızca açık rızanız üzerine çalıştırılmaktadır (KVKK m.5/1). Bu araca ilişkin tercihinizi, çerez tercih panelindeki pazarlama kategorisinden dilediğiniz zaman geri alabilirsiniz.
3.7. Kamuya açık kaynaklardan elde edilen veriler
Kurumsal internet siteleri, mesleki ağ platformları ve kamuya açık ticari kaynaklardan; iş rolü, unvan, kurum büyüklüğü, sektör ve kurumsal iletişim bilgisi gibi iş hayatına ilişkin veriler elde edilebilir. Bu kapsamda kişisel verisi işlenen ilgili kişilere, KVKK m.10 ve GDPR m.14 uyarınca ilk temas anında bu politikaya erişim sağlanır.
3.8. Müşteri ve müşteri adayı temsilcilerine ilişkin veriler
Ticari ilişki kurulan veya kurulması öngörülen kurumların yetkili kişilerine ait ad-soyad, unvan, iş e-postası, kurum bilgisi ile görüşme ve yazışma kayıtları.

5. Otomatik Karar Verme ve Profilleme
Site üzerinden ulaşan taleplerin önceliklendirilmesi ve ilgili ekip üyesine yönlendirilmesi amacıyla; kurum büyüklüğü, sektör, gezinme geçmişi ve etkileşim verilerine dayalı puanlama ve segmentasyon uygulanabilir. 3.6'da açıklanan kurumsal tanımlama verisi bu değerlendirmede kullanılabilir.
Bu işlemler, tarafınıza hukuki sonuç doğuran veya sizi benzer şekilde önemli ölçüde etkileyen münhasıran otomatik bir karar oluşturmaz; nihai değerlendirme ve iletişim kararı insan denetimindedir. KVKK m.11/g uyarınca itiraz hakkınız saklıdır.
6. Sunucu Tarafındaki İşlemeler
Site, Vercel altyapısında barındırılmakta ve sunucu bölgesi olarak Frankfurt kullanılmaktadır.

7. Yapay Zekâ Destekli Sistemlerin Kullanımı
Şirket, içerik üretimi ve analiz süreçlerinde yapay zekâ destekli araçlar kullanmaktadır. Bu kapsamda; sağlayıcılara iletilen veriler işin görülmesi için gereken asgari ölçüyle sınırlıdır, sağlayıcılarla verilerin model eğitiminde kullanılmamasını öngören kurumsal düzeyde sözleşmeler akdedilir ve üretilen çıktılar nihai kararlara esas alınmadan önce insan tarafından gözden geçirilir.
8. Veri Sorumlusu ve Veri İşleyen Ayrımı
Şirket, müşterilerine büyüme, pazarlama ve satış operasyonlarının kurulması ile müşteri ilişkileri yönetimi sistemlerinin yapılandırılması hizmetleri sunmaktadır. Bu hizmetlerin ifası sırasında müşterinin kendi müşteri ve müşteri adaylarına ait kişisel verilere erişilmesi söz konusu olabilir.
İşlemenin amaç ve vasıtalarını belirleyen taraf müşteridir ve veri sorumlusu sıfatını taşır.
Şirket, müşterinin talimatları doğrultusunda hareket eden veri işleyen konumundadır.
Taraflar arasında KVKK m.12/2 ve GDPR m.28 uyarınca ayrı bir veri işleme sözleşmesi akdedilir.
Şirket, müşteri verilerini kendi amaçları için kullanmaz ve müşterinin yazılı talimatı olmaksızın üçüncü kişilere aktarmaz.
Hizmet ilişkisinin sona ermesi hâlinde müşteri verileri, müşterinin tercihine göre iade edilir veya silinir.
Bu faaliyetler bakımından ilgili kişiler, veri sorumlusu sıfatını haiz müşteriye başvurmalıdır.
9. Veri Aktarılan Taraflar
9.1. Yurt içi aktarımlar
Kişisel verileriniz; bilgi teknolojileri destek sağlayıcılarımıza, mali müşavirimize ve hukuk danışmanımıza, yalnızca amaçların gerektirdiği ölçüde ve KVKK m.8 uyarınca aktarılabilir. Kanunen yetkili kamu kurum ve kuruluşlarına mevzuat çerçevesinde aktarım yapılır.

Vercel hakkında not: Sunucu bölgesinin Almanya olması, sağlayıcının ABD'de kurulu bulunması sebebiyle ABD hukukuna tabi erişim taleplerine ilişkin riski tek başına ortadan kaldırmaz. Bu husus, aktarım güvencelerinin belirlenmesinde dikkate alınmıştır.

11. Veri Güvenliği
KVKK m.12 uyarınca alınan teknik ve idari tedbirler:
Aktarım sırasında şifreleme (TLS),
Form gönderimlerinde bot koruması (Cloudflare Turnstile), geçici e-posta adreslerinin reddi ve IP adresi başına saatte beş gönderim sınırı,
Form sınırlaması amacıyla tutulan IP verisinin diske yazılmaması suretiyle veri minimizasyonu,
Rol bazlı erişim yetkilendirmesi ve çok faktörlü kimlik doğrulama,
Personel gizlilik taahhütleri ve hizmet sağlayıcılarla veri işleyen sözleşmeleri,
İhlal müdahale prosedürü ve düzenli gözden geçirme.
Kişisel verilerin hukuka aykırı olarak elde edilmesi hâlinde KVKK m.12/5 uyarınca en kısa sürede ilgili kişiye ve Kurul'a bildirim yapılır.
12. İlgili Kişi Olarak Haklarınız (KVKK m.11)
Kişisel verilerinizle ilgili olarak: işlenip işlenmediğini öğrenme, işlenmişse buna ilişkin bilgi talep etme, işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme, yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme, eksik veya yanlış işlenmiş olması hâlinde düzeltilmesini isteme, KVKK m.7'de öngörülen şartlar çerçevesinde silinmesini veya yok edilmesini isteme, düzeltme, silme ve yok etme işlemlerinin aktarıldığı üçüncü kişilere bildirilmesini isteme, münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme ve kanuna aykırı işleme sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme haklarına sahipsiniz.
13. Başvuru Usulü
Taleplerinizi, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ uyarınca iletebilirsiniz:

Başvurunuzda ad-soyad, imza (yazılı başvuruda), T.C. kimlik numarası (yabancılar için pasaport numarası), tebligata esas adres, varsa bildirime esas e-posta/telefon ve talep konusu yer almalıdır.
Başvurular en geç 30 gün içinde ücretsiz olarak sonuçlandırılır. Başvurunuzun reddedilmesi, cevabı yetersiz bulmanız veya süresinde cevap verilmemesi hâlinde, cevabı öğrendiğiniz tarihten itibaren 30 ve her hâlde başvuru tarihinden itibaren 60 gün içinde Kişisel Verileri Koruma Kurulu'na şikâyette bulunabilirsiniz.
14. Avrupa Ekonomik Alanı ve Birleşik Krallık'tan Erişen Ziyaretçiler İçin Ek Bilgiler
GDPR'ın uygulanabilir olduğu hâllerde; erişim, düzeltme, silinme, işlemenin kısıtlanması, veri taşınabilirliği ve meşru menfaate dayalı işlemeye itiraz haklarına sahipsiniz. Doğrudan pazarlama amacıyla yapılan işlemeye her zaman ve gerekçesiz olarak itiraz edebilirsiniz. Açık rızaya dayalı işlemelerde rızanızı dilediğiniz zaman geri alabilirsiniz; geri alma, öncesindeki işlemenin hukuka uygunluğunu etkilemez. İkamet ettiğiniz ülkedeki denetim otoritesine şikâyette bulunma hakkınız saklıdır.
15. Çocuklara İlişkin Veriler
Site, 18 yaşından küçük kişilere yönelik değildir ve bu kişilerden bilerek kişisel veri toplanmaz. Bu yönde bir veri işlendiğinin tespiti hâlinde ilgili veriler gecikmeksizin silinir.
16. Değişiklikler
Bu politika, mevzuat değişiklikleri veya işleme faaliyetlerimizdeki güncellemeler doğrultusunda revize edilebilir. Güncel metin her zaman bu sayfada yayımlanır.

2. Scope
This policy explains how your personal data is processed when you visit momentumnexus.com (the "Site") or complete one of the forms on it.
Outside the scope:
application services provided through app.momentumnexus.com and the Hubty, Birexit and Girisim101 products, which are subject to separate notices;
career applications, handled through a third-party recruitment platform where a separate candidate notice is provided;
personal data processed in projects carried out on behalf of our clients, where the Company acts as a data processor (see Section 8).
The Site is published in English and addresses an international audience. Section 14 applies as a supplementary layer where the GDPR is applicable to visitors from the European Economic Area or the United Kingdom.
3. Personal Data We Process and How We Collect It

No form on the Site requests a telephone number.
All forms are protected by bot filtering (Cloudflare Turnstile), rejection of disposable email addresses, and a limit of five submissions per IP address per hour.
3.2. Specific note on ICP Finder
The LinkedIn profile URL entered into ICP Finder is data capable of directly identifying a specific individual.
If you enter profile URLs belonging to third parties rather than your own, you remain responsible for ensuring that the disclosure rests on a lawful basis and that the individuals concerned have been informed. We recommend that you do not enter trade secrets into the product description field; that field is not received under an obligation of confidentiality.
3.3. Meeting requests
Meeting requests are taken through the Calendly tool embedded in the Site. When you complete that form, your data is transmitted directly to Calendly and does not pass through the Company's servers. Calendly applies its own privacy policy to that processing; the Company acts as controller from the point at which the booking record reaches it.

No tool other than those strictly necessary is activated without your explicit consent.
3.5. Session recording and heatmaps
We use Hotjar (site ID 5010978) to assess the usability of the Site. In addition to collecting heatmaps, click and scroll behaviour, this tool may turn your visit into a session recording that can subsequently be replayed.
Session recording is activated only with your explicit consent (Article 5/1 of the KVKK).
Configuration is applied so that text entered into form fields is masked in recordings. Even so, we recommend that you do not enter sensitive or confidential information into form fields, since what you type may be captured even if you do not submit the form.
3.6. Identification of the visiting organisation
The Site uses Leadfeeder / Dealfront. This tool performs a reverse lookup on the visitor's IP address to identify the company from which the visit originates, and combines the on-site browsing history attributed to that company over time.
The resulting information is used to see which organisations are reviewing which of our pages, to prioritise business development activity, and to identify the contacts to approach.
As a rule the tool aims to identify an organisation rather than an individual. However, the processing itself operates on the IP address, which is personal data, and in organisations with few employees the combination of browsing history with form records may make an individual identifiable again. The processing is therefore treated as processing of personal data and is activated only with your explicit consent (Article 5/1 of the KVKK). You may withdraw your preference for this tool at any time through the marketing category in the cookie preference panel.
3.7. Data obtained from publicly available sources
We may obtain business-related data — job role, seniority, organisation size, sector and corporate contact details — from corporate websites, professional networking platforms and publicly available commercial sources. Individuals whose data is processed in this way are given access to this policy at the point of first contact, in accordance with Article 10 of the KVKK and Article 14 of the GDPR.
3.8. Data relating to representatives of clients and prospective clients
Name and surname, job title, business email, organisation, and records of meetings and correspondence relating to individuals authorised to act for organisations with which a commercial relationship exists or is contemplated.

5. Automated Decision-Making and Profiling
To prioritise incoming enquiries and route them to the right team member, we may apply scoring and segmentation based on organisation size, sector, browsing history and engagement data. The organisational identification data described in 3.6 may be used in that assessment.
These operations do not constitute a decision based solely on automated processing producing legal effects concerning you or similarly significantly affecting you; the final assessment and contact decision remains under human control. Your right of objection under Article 11/g of the KVKK is reserved.
6. Server-Side Processing
The Site is hosted on Vercel, with Frankfurt as the server region.

7. Use of AI-Assisted Systems
The Company uses AI-assisted tools in content production and analysis. Data transmitted to providers is limited to the minimum necessary; enterprise-level agreements stipulate that data is not used for model training; and outputs are reviewed by a human before informing any final decision.
8. Controller and Processor Roles
The Company provides its clients with services covering the design of growth, marketing and sales operations and the configuration of customer relationship management systems. Performing these services may involve access to personal data relating to the client's own customers and prospects.
The party determining the purposes and means of processing is the client, who acts as controller.
The Company acts solely on the client's instructions as a data processor.
The parties enter into a separate data processing agreement under Article 12/2 of the KVKK and Article 28 of the GDPR.
The Company does not use client data for its own purposes and does not transfer it to third parties without the client's written instruction.
On termination of the engagement, client data is returned or deleted at the client's election.
For those activities, data subjects should address the client acting as controller.
9. Recipients of Personal Data
9.1. Domestic transfers
Your personal data may be shared with our IT support providers, financial adviser and legal counsel, strictly to the extent required by the purposes above and in accordance with Article 8 of the KVKK. Disclosures to authorised public authorities are made in accordance with applicable legislation.

Note on Vercel: the fact that the server region is Germany does not by itself remove the risk arising from access requests under US law, because the provider is established in the USA. This has been taken into account in determining the transfer safeguards.

Once the applicable period expires, personal data is erased, destroyed or anonymised.
11. Data Security
Technical and organisational measures under Article 12 of the KVKK:
encryption in transit (TLS);
bot protection on form submissions (Cloudflare Turnstile), rejection of disposable email addresses, and a limit of five submissions per IP address per hour;
data minimisation, in that IP data held for rate limiting is not written to disk;
role-based access authorisation and multi-factor authentication;
confidentiality undertakings for personnel and data processing agreements with service providers;
an incident response procedure and periodic review.
Where personal data is unlawfully obtained, notification is made to the affected individuals and to the Board as soon as possible under Article 12/5 of the KVKK.
12. Your Rights under Article 11 of the KVKK
You have the right to learn whether your personal data is processed; to request information if it has been processed; to learn the purpose of processing and whether the data is used in accordance with that purpose; to know the third parties to whom the data is transferred domestically or abroad; to request rectification of incomplete or inaccurate data; to request erasure or destruction under Article 7; to request that rectification, erasure and destruction be notified to third-party recipients; to object to an outcome adverse to you arising from analysis carried out solely by automated means; and to claim compensation for damage suffered as a result of unlawful processing.
13. How to Exercise Your Rights

Your request should include your name and surname, signature (for written applications), Turkish ID number (passport number for foreign nationals), address for service, any email or telephone number for notification, and the subject of your request.
We respond within 30 days, free of charge. If your request is refused, the response is inadequate, or no response is given in time, you may file a complaint with the Personal Data Protection Board within 30 days of learning the response and in any event within 60 days of your application.
14. Additional Information for Visitors from the EEA and the United Kingdom
Where the GDPR applies, you have the rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing based on legitimate interests. You may object to processing for direct marketing purposes at any time and without giving reasons. Where processing is based on consent, you may withdraw it at any time; withdrawal does not affect the lawfulness of processing carried out beforehand. You also have the right to lodge a complaint with the supervisory authority in your country of residence.
15. Children's Data
The Site is not directed at persons under the age of 18 and we do not knowingly collect their personal data. Any such data identified will be deleted without delay.
16. Changes
We may revise this policy in line with legislative developments or changes to our processing activities. The current version is always published on this page.
