2. Onayın Kapsamı
6563 sayılı Elektronik Ticaretin Düzenlenmesi Hakkında Kanun ve Ticari İletişim ve Ticari Elektronik İletiler Hakkında Yönetmelik uyarınca, MNB Teknoloji Danışmanlık Sanayi ve Ticaret Limited Şirketi tarafından tarafınıza aşağıdaki içerikte ticari elektronik ileti gönderilmesine onay vermektesiniz:
Bülten ve sektörel içerik gönderimi
Yeni hizmet, paket ve ürünlere ilişkin bilgilendirme
Ücretsiz kaynak, şablon ve rehberlerin duyurulması
Webinar, etkinlik ve sunum davetleri
Kampanya, indirim ve özel teklif duyuruları
İleti kanalları: E-posta ve/veya kısa mesaj (SMS).
İşlenecek veriler: Ad-soyad, e-posta adresi, telefon numarası, temsil ettiğiniz kurum bilgisi ile onay kaydına ilişkin veriler (onay tarihi, onay kanalı, IP adresi).
3. Onay Verme Şekli ve Onayın Bağımsızlığı
Onay; internet sitemizdeki ilgili kutucuğun tarafınızca işaretlenmesi, fiziki ortamda yazılı beyan verilmesi veya İleti Yönetim Sistemi (İYS) üzerinden onay verilmesi yoluyla alınır.
Onay kutucuğu önceden işaretlenmiş olarak sunulmaz ve olumlu irade beyanınızı gerektirir.
Ticari elektronik ileti onayı; ücretsiz kaynak talebi, iletişim formunun gönderilmesi, toplantı planlanması veya kullanım şartlarının kabulü ile birleştirilemez. Bu işlemlerin gerçekleştirilmesi, ileti onayı verilmesi şartına bağlanamaz ve tek başına onay anlamına gelmez. Ücretsiz kaynak talebinde bulunmanız halinde, talep ettiğiniz kaynak size her hâlükârda iletilir; ileti almak isteyip istememeniz bu sonucu değiştirmez.
4. Tacir ve Esnaf Sıfatını Haiz Alıcılar
Alıcının tacir veya esnaf olması halinde, mevzuat uyarınca önceden onay alınmaksızın ticari elektronik ileti gönderilebilir. Bu durumda dahi:
İleti gönderimi İleti Yönetim Sistemi üzerinden yürütülür,
Alıcının reddetme hakkı her iletide açıkça sunulur,
Reddetme bildiriminin alınmasından itibaren üç iş günü içinde gönderim durdurulur.
Alıcının reddetme hakkını kullanması halinde, onay alınmadıkça yeniden ticari elektronik ileti gönderilmez.
5. Müşteri Adına Yürütülen Kampanyalar
Şirket, müşterilerine satış ve pazarlama altyapısı kurulması hizmeti sunmaktadır. Müşteriler adına yürütülen elektronik ileti kampanyalarında:
İletinin hizmet sağlayıcısı ve göndericisi müşteridir; İYS kaydı, onay alınması ve onayın ispatı yükümlülüğü müşteriye aittir.
Şirket, bu kampanyalarda yalnızca teknik altyapı ve operasyon desteği sunar.
Şirket ile müşteri arasındaki hizmet sözleşmesinde, müşterinin mevzuata uygun onay temin ettiğine ilişkin taahhüt ve buna aykırılık halinde sorumluluk dağılımı ayrıca düzenlenir.
İşbu metin, yalnızca MNB Teknoloji Danışmanlık Sanayi ve Ticaret Limited Şirketi'nin kendi adına gönderdiği ticari elektronik iletileri kapsar.
6. İleti Yönetim Sistemi (İYS)
MNB Teknoloji Danışmanlık Sanayi ve Ticaret Limited Şirketi, İleti Yönetim Sistemi'ne kayıtlıdır. Alınan onaylar, onay tarihinden itibaren üç iş günü içinde İYS'ye kaydedilir. Onay ve ret durumunuzu dilediğiniz zaman iys.org.tr üzerinden görüntüleyebilir ve değiştirebilirsiniz. İYS üzerinden yapacağınız değişiklikler sistemimize otomatik olarak yansır.
7. Reddetme Hakkı
Ticari elektronik ileti almayı reddetme hakkınızı, herhangi bir gerekçe göstermeksizin ve ücretsiz olarak dilediğiniz zaman kullanabilirsiniz. Bunun için:
Gönderilen her iletinin içinde yer alan ret bağlantısını kullanabilir,
iys.org.tr üzerinden tercihinizi güncelleyebilir,
info@momentumnexus.com adresine talebinizi iletebilirsiniz.
Ret bildiriminizin ulaşmasından itibaren üç iş günü içinde ileti gönderimi durdurulur.
8. İletilerin İçeriği
Gönderilecek ticari elektronik iletilerde; hizmet sağlayıcının ticaret unvanı, MERSİS numarası, iletişim bilgileri, iletinin ticari nitelikte olduğunu belirten ifade ve reddetme imkânı yer alır.
9. Onayın İspatı ve Kayıtların Saklanması
Onayın varlığını ispat yükümlülüğü hizmet sağlayıcıya aittir. Bu kapsamda:
Onay kayıtları, onayın geçerliliğinin sona erdiği tarihten itibaren bir yıl süreyle,
Gönderilen ticari elektronik iletilerin kayıtları, gönderim tarihinden itibaren bir yıl süreyle
saklanır. Uyuşmazlık halinde bu süreler, uyuşmazlık sonuçlanıncaya kadar uzayabilir.
10. Kişisel Verilerin Korunması
Bu kapsamda işlenen kişisel verileriniz, 6698 sayılı Kanun ve Gizlilik Politikası'nda açıklanan esaslar çerçevesinde işlenir. Ticari elektronik ileti onayının geri alınması, kişisel verilerinizin diğer hukuki sebeplere dayalı olarak işlenmesini kendiliğinden sona erdirmez; bu yöndeki taleplerinizi Gizlilik Politikası'nın 12. bölümündeki kanallar üzerinden iletebilirsiniz.

2. Scope of Consent
Under Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, you consent to receiving commercial electronic messages from MNB Teknoloji Danışmanlık Sanayi ve Ticaret Limited Şirketi covering:
newsletters and sector content;
information about new services, packages and products;
announcements of free resources, templates and guides;
invitations to webinars, events and presentations;
campaign, discount and special offer announcements.
Channels: email and/or short message service (SMS).
Data processed: name and surname, email address, telephone number, the organisation you represent, and consent records (date, channel, IP address).
3. How Consent is Given and its Independence
Consent is obtained by ticking the relevant box on our website, by written declaration in physical form, or through the Message Management System (İYS).
The consent box is not pre-ticked and requires your affirmative action.
Consent to commercial electronic messages cannot be bundled with a free resource request, submission of the contact form, booking a meeting, or acceptance of the terms of use. Completion of those actions cannot be made conditional on giving consent, and does not by itself constitute consent. If you request a free resource, that resource will be delivered to you in any event, whether or not you choose to receive messages.
4. Recipients Who Are Merchants or Tradespeople
Where the recipient is a merchant or tradesperson, commercial electronic messages may be sent without prior consent under applicable legislation. Even in that case:
messages are managed through the Message Management System (İYS);
the right to opt out is clearly offered in every message;
sending is stopped within three business days of receiving an opt-out notice.
Once a recipient has opted out, no further commercial electronic message is sent unless consent is obtained.
5. Campaigns Run on Behalf of Clients
The Company provides its clients with services covering the build-out of sales and marketing infrastructure. In electronic message campaigns run on behalf of clients:
the service provider and sender of the message is the client; the obligations to register with İYS, obtain consent and prove that consent rest with the client;
the Company provides only technical infrastructure and operational support in such campaigns;
the service agreement between the Company and the client separately records the client's undertaking that consent has been obtained in compliance with applicable law, and allocates liability in the event of breach.
This notice covers only commercial electronic messages sent by MNB Teknoloji Danışmanlık Sanayi ve Ticaret Limited Şirketi on its own behalf.
6. Message Management System (İYS)
MNB Teknoloji Danışmanlık Sanayi ve Ticaret Limited Şirketi is registered with the Message Management System. Consents received are recorded in İYS within three business days. You may view and change your consent or opt-out status at any time via iys.org.tr; changes made there are reflected automatically in our systems.
7. Right to Opt Out
You may exercise your right to refuse commercial electronic messages at any time, free of charge and without giving a reason, by:
using the opt-out link included in every message;
updating your preference at iys.org.tr;
writing to info@momentumnexus.com.
Sending is stopped within three business days of receipt of your opt-out notice.
8. Content of Messages
Commercial electronic messages include the service provider's legal name, MERSIS number and contact details, a statement identifying the message as commercial, and an opt-out facility.
9. Proof of Consent and Retention of Records
The burden of proving the existence of consent lies with the service provider. Accordingly:
consent records are retained for one year from the date the consent ceases to be valid;
records of commercial electronic messages sent are retained for one year from the date of dispatch.
In the event of a dispute, these periods may be extended until the dispute is resolved.
10. Personal Data Protection
Personal data processed in this context is handled in accordance with Law No. 6698 and the principles set out in our Privacy Policy. Withdrawing consent to commercial electronic messages does not in itself end the processing of your personal data on other legal bases; related requests may be submitted through the channels in Section 12 of the Privacy Policy.
